BINDING ARBITRATION — WAIVER OF JURY TRIAL AND CLASS ACTIONS
EXCEPT FOR DISPUTES INVOLVING INTELLECTUAL PROPERTY RIGHTS OR CLAIMS THAT MAY NOT BE ARBITRATED UNDER APPLICABLE LAW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT. YOU AND MY DIGITAL KUBE EACH WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. The arbitration will be conducted in Cook County, Illinois or remotely at your election. This arbitration agreement survives termination of your relationship with us.

AND MY DIGITAL KUBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.
